The Legislation Institute of the VerkhovnaRada of Ukraine is a basic scientific-research
institution that provides the VerkhovnaRada of Ukraine
with analytical and legal support of its legislative activity. It was
established on October 7,
1994 by the Resolution of the Presidium of the VerkhovnaRada of Ukraine
implementing the Decision of the VerkhovnaRada of Ukraine
on October 22, 1992.
The Statute of the Legislation Institute was approved by Order of the Chairman
of the VerkhovnaRada of
Ukraine No 770 on August 4,
2003 (the Statute was amended according to the Orders of November
19, 2003; December 10, 2004;March
30,2006 and December 17, 2013).
The main objectives of the Institute are
the preparation of proposals on strategy formation for the State legal policy
of the VerkhovnaRada of
Ukraine; elaboration of the scientific concepts of national legislation
development; carrying out comparative research on Ukrainian legislation and
that of the foreign states, as well as the problems of bringing the national
legislation into conformity with international legal rules. The Institute is
also entrusted with tasks concerning preparation of projects of the prospective
and the current State drafting programs of the VerkhovnaRada of Ukraine; organization of the monitoring of
the current effectiveness of Ukrainian legislation and its application results
forecasting; preparation of draft laws on the most important issues of society
and state development, as well as their scientific justification; carrying out
scientific expertise on drafts of the Ukrainian legislative acts etc.
To carry out these tasks the specialists
of the Institute perform fundamental and applied research of the development of
Ukrainian legislation; analyze the effectiveness of the mechanism of the
application of current legislation; elaborate proposals concerning elimination
of the inconformity and the contradictions between certain acts of the
legislation and filling up of the legal gaps. The Institute also provides for
the preparation of proposals concerning legislative support of fulfillment of
international obligations as well as supports the adaptation of the Ukrainian
legislation with that of the EU.
A highly important place in the work of
the Institute is assigned to the problems of comparative jurisprudence,
cooperation with foreign scientific institutions and organizations that
contribute to the enrichment of the national legal traditions and ensures the
opportunity of the direct participation of Ukraine in Pan-European law making.
Correspondingly, the officials of the
Institute study experiences of the organization of lawmaking and legislative
activity in foreign countries and coordinate the participation of the national
scientific organizations and centers in the research concerning lawmaking,
systematization and codification of national legislation etc.
